Andrew Lewinter is a Eugene, Oregon labor and employment attorney representing labor unions and individual employees. Mr. Lewinter has been an attorney for both public and private sector labor unions in a wide spectrum of fields, including musicians, film technicians, teachers, stage hands, and public works employees. Mr. Lewinter litigates employment discrimination cases in state and federal courts and before state and federal administrative agencies, such as the Oregon Bureau of Labor and Industries (BOLI) and the National Labor Relations Board (NLRB).
Mr. Lewinter graduated cum laude from Georgia State University College of Law, where he also served as Lead Articles Editor of the Georgia State Law Review. There, he wrote and had published a law review article about the rights of undocumented workers after the United States Supreme Court's decision in Hoffman Plastic Compounds, Inc. v. NLRB.1 Following law school, he was Legal Counsel for the National Labor Relations Board (NLRB) in Washington, D.C., where he helped draft NLRB decisions and guide labor law and policy.
Mr. Lewinter was a symphony musician for fourteen years prior to becoming an employment attorney and labor attorney. Before training to become a lawyer, he actively participated in collective bargaining and representation of employees as chairman of the musicians' representative committee. That experience nurtured a strong belief in unionism and the rights of employees, and eventually inspired him to become a labor and employment attorney. Mr. Lewinter's working experience prior to becoming an employment lawyer gave him a practical understanding of the dynamic of the workplace; his work as a labor attorney at the NLRB provided legal knowledge to apply to that background.
Mr. Lewinter is an employment attorney who represents both individuals and labor unions. Mr. Lewinter's work as a lawyer for individuals includes representation of employee victims of employment discrimination and retaliation, including race discrimination, national origin discrimination, religious discrimination, age discrimination, sex discrimination, sexual orientation discrimination, sexual harassment, sexual orientation harassment, disability discrimination, FMLA and OFLA discrimination, whistleblowing claims, ERISA claims for denial of employee benefits, and retaliation for having used workers' compensation benefits. Mr. Lewinter also litigates cases against employers who have failed to pay the required minimum wage or overtime. Mr. Lewinter speaks Spanish, and has experience as an employment attorney for employees who do not speak English.
Mr. Lewinter is licensed as a lawyer in Oregon and on inactive status as an attorney in Maryland and New Mexico. He is admitted to practice law in all Oregon state and federal courts. He is a member of several attorney organizations, including the Lane County Bar Association, the Oregon Trial Lawyers Association and the National Employment Lawyers Association.
